Getting a DUI, or into what some refer to as a drunk driving crash, in the state of Illinois is serious business.

FIRST OFFENSE—ILLINOIS DUI–FINES

• a Class A misdemeanor
• fines amounting up to $2,500.00
• court supervision for up to two years
• DUI Tech Fee of $750.00 (P.A. Act 96-1342 eff. 1-1-11)
• A $50.00 Roadside Memorial Fund Fee (730 ILCS 5/5-9-1.17)

SECOND OFFENSE—ILLINOIS DUI—FINES & MANDATORY CONVICTION

• Class A misdemeanor
• mandatory conviction such as five days in jail or 240 hours of community service.

THIRD OFFENSE—ILLINOIS DUI—FINES & PRISON

• Class A felony

FOURTH OFFENSE—ILLINOIS DUI—FINES & PRISON

• Class A felony (non-probationable)
• 3-7 years in prison
• fines up to $25,000.00
• DUI Tech Fee of $1,000.00
• $50.00 Roadside Memorial Fund Fee (730 ILCS 5/5-9-1.17)

FIFTH OFFENSE—ILLINOIS DUI—FINES & PRISON

• Class 1 felony (non-probationable)
• 4-15 years in prison
• fines up to $25,000.00
• DUI Tech Fee of $1,000.00
• $50.00 Roadside Memorial Fund Fee (730 ILCS 5/5-9-1.17)

SIXTH OFFENSE—ILLINOIS DUI—FINES & PRISON

• Class X felony (non-probationable)
• 6-30 years in prison
• fines up to $25,000.00
• DUI Tech Fee of $1,000.00
• $50.00 Roadside Memorial Fund Fee (730 ILCS 5/5-9-1.17)
